Ottomation Acceptable Use Policy

Ottomation Inc. reserves the right to refuse, suspend, or terminate service at any time.

Ottomation Inc. does not host any site that engages in illegal activities of any nature. Ottomation Inc. does not host any site that engages in activities prohibited by the terms of use set forth in this document.

.For the purpose of this policy, illegal and/or prohibited activities include, but are certainly not limited to:

•  Ottomation Inc. does not host any site that engages in illegal activities of any nature.
• Storing and/or distributing illegal copies of copyrighted software.
• Violating trademarks and copyrights.
• Violating U.S. Federal export laws.
• Selling and/or distributing illegal contraband.
• Distribution of unsolicited Email (spamming).
• Adult sites or sites which contain adult content All material of pornographic nature is considered adult content.
• Sites containing child pornography.
• Posting, advertising, transmitting, re-transmitting or storing material on or through any of Ottomation 's system services or products that is in violation of any local, state, federal or non-United States law or regulation.

Ottomation Inc. will terminate any account that engages in any form of Internet abuse, which includes, but is not limited to:

• Distribution of unsolicited Email (spamming).
• Distribution of mass E-mailing software/tools/systems.
• Attempting to circumvent user authentication or security of any host, network, or account on Ottomation Inc. servers or the Internet at large ("cracking").
• Attempting, in any way, to interfere with or deny service to any user or any host on the Internet.
• Cross-posting messages to Usenet newsgroups.
• Using an account at another provider to promote a Web site hosted on a Ottomation Inc. Server in an abusive manner.
• Using a Ottomation Inc. account to collect replies to messages sent from another provider which violate these rules or the rules of that provider.
• Mail bombing Internet users.
• Running packet sniffers or port scanners.
• Sending and/or relaying email through our servers for domain names for which we do not provide primary DNS service.

Ottomation Inc. will not accept or tolerate web sites on our servers which are dedicated to or contain content which promotes hatred of and/or discrimination against groups or individuals based on race, color, national or ethnic origin, religion, gender or disability. Any and all web sites found to be in violation of this Policy will be terminated immediately and without prior notification. Additionally, Ottomation Inc. reserves the right to turn over any and all such material to relevant law enforcement and regulatory authorities both in the jurisdiction in which our servers reside and/or in the jurisdiction of the responsible client.

Ottomation Inc. will terminate any account that engages in abuse of our servers, and/or our or our client sites. This abuse includes, but is not limited to:

• Excessive use of CPU resources.
• Attempting to gain access to the root account and/or other customers' accounts (hacking).
• Installing continuously running programs such as, but not limited to, IRC bots and chat servers.
• Reselling and/or remotely hosting for free or a fee of CGI scripts which are hosted on Ottomation Inc. servers.

The customer is solely responsible for the content of their web site.

Ottomation Inc. has the right to delete all data, files, or other information in the customers web site account, if the customer's account with Ottomation Inc. is terminated, for any reason, by either Ottomation Inc. or the customer.

Should a violation of this user policy occur, the primary account holder will be held responsible for any damages to Ottomation's business, service, equipment, network, operations, or reputation resulting from the user's actions including, but not limited to, government actions, vandalism, retaliation, and claims of libel, unfair competition, infringement of patent, copyright, trademark, service mark, or other intellectual property rights, violation of privacy, or other tort.

The use of Ottomation 's web hosting service is at the customers sole risk. Neither Ottomation Inc., its employees, affiliates, third party services, merchant licensors or the like, warrant that Ottomation 's web hosting service will not be interrupted or error free. While we will indeed make every good faith effort to ensure that our web servers are available to as many Internet users as possible and that there is minimal interruption of service as possible, under no circumstance will Ottomation Inc., its partners, its employees, or its affiliates be liable for any claims, any action either direct, indirect, special, incidental, or consequential, or any damages either punitive or alleged to have resulted, including loss of profits, from the use of or inability to use Ottomation's service, from service interruptions, from customer errors or problems with their Internet connectivity, from unauthorized access to Ottomation Inc. servers, from communication failure, from bandwidth congestion or interruptions, or other Internet failures or interruptions.

Accounts 60 days past due are terminated. In addition to payment of all past due amounts, a fee of $25.00 per domain/sub domain name is charged to re-activate a past due account.
